On Monday, March 26, a study was published which proves that the oil from the BP oil spill of April 2010 is linked to the injured and dying corals in the Gulf waters. The damaged coral reef about seven miles southwest of BP’s Macondo well was covered in a black, heavy mucous material.

Researchers from Penn State University, Temple University, Woods Hole Oceanographic Institution, and the U.S. Geological Survey published their findings after studying the Gulf waters coral communities in the Proceedings of the National Academy of Sciences.

The scientists discovered the once brightly colored coral in October 2010 and suspected that the BP oil spill might be the culprit. Oil is naturally found in the Gulf so it was necessary for the research team to pinpoint the source of the slow death of the 54 coral communities.

Oil is Found to be From the Deepwater Horizon Explosion

Oil is made up of complex mixtures of chemical compounds and in order to determine the source of the oil, it was necessary to separates the compounds by their molecular weight. This analysis, along with reviewing the images taken at the site of the coral communities allowed the researchers to determine that the oil did indeed come from the over 200 million gallons of oil that originated from the well involved in the Deepwater Horizon drill rig explosion and BP oil spill in April 2010. The oil poured into the Gulf waters for almost three months before a cap was placed on the well.

Long Term Effects on Animal Life in the Gulf Unknown

According to the lead author of the study, chemist Helen White, the effects of the BP oil spill were more far-reaching than surface oil spills. “We would not expect deep-water corals to be affected by a typical oil spill. But the sheer magnitude of the Deepwater Horizon oil spill makes it very different from a tanker running aground and spilling its contents.” “These findings will have a significant effect on deep-water drilling, and on the monitoring of oil spills in the future,” White says.

Whether the coral will recover is unknown. The bare skeletons covered in loose tissue do suggest however that the BP oil spill has had a serious impact on animal life in the Gulf. The damage to the coral located 4300 feet below the surface of the water may indicate that other areas of the Gulf.

On March 6, 2012, the Journal of Neurosurgery (JNS) published a report that Pradaxa may be responsible for irreversible bleeding complications after an elderly gentleman died as a result of a brain hemorrhage.

Pradaxa (dabigatran), manufactured by Boehringer Ingelheim, is a prescription blood thinner medication. Pradaxa is part of a new class of medications recently approved by the US Food and Drug Administration (FDA) to prevent strokes in patients with atrial fibrillation which is the most common type of heart rhythm abnormality especially among the elderly. This new class of drugs was developed to replace the use of warfarin (Coumadin), which has a high risk of bleeding and needs to be closely monitored.

The 83 year old man mentioned in the JNS report was treated at the University of Utah medical center after a routine fall. Initial evaluations showed serious complications, however two hours later CT scans indicated extensive brain hemorrhaging. Doctors were unable to stop the hemorrhaging and patient died as a result of the hemorrhaging. Unfortunately, falls are commonplace among the elderly which raises concerns that many who take Pradaxa for stroke prevention may instead suffer from serious bleeding risks.

While warfarin and Pradaxa may both have serious bleeding risks, there are measures that can be taken to negate any severe bleeding that may occur as a result of using warfarin. There are no such methods to date with Pradaxa. “In the event of traumatic hemorrhage in patients receiving dabigatran … there are currently no effective reversal agents” to neutralize the drug, the report said.

http://www.foxnews.com/health/2012/03/07/death-magnifies-pradaxa-hemorrhage-concerns/

It has only been a few days since the $7.8 billion agreement between BP PLC and the steering committee for a large group of plaintiffs. While it still needs to be cleared by the federal courts, there are some that have yet to be won over by the settlement offer.

Critics are not sure that this agreement will be better for those hurt by the BP Oil Spill of 2010 than the $20 billion compensation fund established by BP in 2010 and administered by the Gulf Coast Claims Facility.

BP Settlement News

The news of a partial settlement does indicate that perhaps claims will be resolved that the GCCF was unwilling or unable to satisfy. In addition, the new arrangement may result in higher dollar amounts for claimants that do qualify. But there is still unanswered questions concerning the timing of these payments and uncertainty about further delays in the resolution of claims. While it is encouraging that the new court claims system will use a broader time period to determine economic losses, the process of establishing eligibility starts anew.

BP Oil Spill Case is Still Far From Over

Madhu Sekharan, an attorney with the Houston firm of D. Miller & Associates, PLLC representing hundreds of individual and business clients with BP Oil spill claims, said that he recognizes that this legal matter is far from being resolved. “Despite news of a settlement, the BP Oil Spill case is still far from being over,” according to Mr. Sekharan. “Those that have been harmed by the nation’s worst environmental disaster in its history, through no fault of their own, seek answers.”

While the proposed settlement is estimated to be worth $7.8 billion, the final figure could eventually be much higher. There are still likely to be thousands of new claims waiting to be submitted while hundreds of thousands of existing claims remain unresolved.

BP Oil Spill Claims Settlement Attorney

D. Miller & Associates, PLLC continues to accept new BP Oil Spill clients as they help claimants navigate these uncharted legal waters. The firm is fully committed to these victims of the catastrophic BP Oil Spill and will fight to receive appropriate compensation be it through negotiation, the new court claims process or continued litigation.

However, almost immediately after stating their readiness to settle, BP Oil announced that they were prepared to fight the civil lawsuits and the government litigation which were scheduled to begin February 27.

Confident BP Oil announced a rise in their fourth quarter earnings and increased its quarterly dividend from 7 cents to 8 cents a share.

The federal trial for BP oil spill has been delayed for a week by US District Judge Carl Barbier because BP Oil is making progress in their settlement talks. The trial was originally scheduled to begin February 27 in New Orleans.

In a joint news release, BP Oil and the Plaintiffs Steering Committee stated that the two were working on an agreement that would “fairly compensate people and businesses affected by the Deepwater Horizon accident and oil spill.”

“There can be no assurance that these discussions will lead to a settlement agreement,” according to the joint statement.

The trial is now scheduled to start March 5 and will hopefully decide how much BP and other companies that are involved will pay those that have filed claims because of the 2010 Deepwater Horizon explosion and BP oil spill.

What is Houston Business Law? Business law, or commercial law, pertains to the formation and governing of businesses. Business law [...]

What is Houston Business Law?

Business law, or commercial law, pertains to the formation and governing of businesses. Business law upholds government regulations and covers different forms of business including corporations, LLC’s, and partnerships.

It falls upon the business law attorney to advise their clients on the best venue for their particular business. There are laws involving contracts, sales, employment, property, taxes and organizations. Business law issues include starting a new business, selling or buying a business, managing a business and contracts. The business law attorney’s advice and counsel is invaluable throughout the life of the business.

Uniform Commercial Code

The Uniform Commercial Code (UCC) which has been adopted in some form by every state in the US, is the primary authority for such issues as employment, sales, and consumer protection. The UCC is divided into nine articles and covers issues that may come up in any commercial transactions and protects fair business practice and due process rights. The nine articles regulate the sale and leases of goods, negotiable instruments, bank deposits and transfers, letters of credit, investment securities, and secured transactions. Your business law attorney will be familiar with how the UCC applies to your particular business need and location.

Legal Business Structures

If you are starting a business, you must first determine which of the many legal business structures apply to the business. Financial implications will vary based on which legal structure you have selected, ranging from corporation responsibilities for annual franchise tax fees to personal liability as a sole proprietorship. You must also properly record the business name as that will be the identifying and marketing branding of the business. It is advised that anyone involved in business whether it be a startup or an ongoing venture to consult an experienced business law attorney for every stage of development.

Some of the legal business structures available in Texas include:

Sole proprietorship – this is the most widely used form of business entity and the ownership and assets are owned by one individual.

General partnership – is when two or more individuals or companies form a business. The partners share equally in debts and assets.

Limited partnership – is similar to general partnership, however the partners have limited debt obligations.

Registered limited liability partnership – is a general partnership that has been filed with the Secretary of State.

Corporation – is when two or more individuals, partnerships, or other companies form a separate entity for the purpose of operating a business in the state.

Limited liability company – is an unincorporated business entity.

Each of these legal business structures have unique regulations which determine how to file the name, apply for certifications and debt obligations. It is vital for a successful business venture that you have selected the proper legal structure and have correctly registered your business name. Your business law attorney will be well suited to advise you on which structure will be best for you and your business needs.
