Thousands of people required revision surgery after their DePuy Orthopaedics hip replacements failed. DePuy, a subsidiary of Johnson & Johnson, recalled its metal-on-metal hip replacement systems in 2010. Still, the manufacturer faces a number of lawsuits claiming it failed to warn patients about the high risk of failure in this type of implant.
If you had to undergo revision surgery after receiving a metal-on-metal hip implant, you may be eligible to file a lawsuit against the device manufacturer. D. Miller & Associates, PLLC offers complimentary case reviews, and can help you understand your legal options for compensation. What Is the Problem with the Recalled DePuy Hip Implant Devices?

DePuy’s metal-on-metal hip implants and replacement systems led to a significantly higher rate of revision surgeries than implants made of other materials. These surgeries repaired or replaced the implants after early failure of the devices. The defective systems and implants include:

  • DePuy Pinnacle
  • ASR XL Acetabular System
  • ASR Hip Resurfacing System

A hip implant can last around 20 years, but many who received defective metal-on-metal implants began experiencing symptoms of failure within the first few years after they received the implant. Many required one or more additional procedures to repair or replace their artificial hip implant.
If you have a DePuy metal-on-metal hip implant, you should pay careful attention if you experience any of these symptoms:

  • Swelling in the area
  • Pain when walking
  • Pain when standing up from a seated position
  • Decreased mobility
  • Pain when bearing weight on the affected side
  • Unexplained thigh, hip, or groin pain

If you have any of these symptoms, it is important to discuss them with your orthopedist. They may be indicative of a defective hip implant that is failing, or other complications related to your artificial hip. Give us a call, as well. We can help you explore your options for getting compensation, but we need to act quickly. You have only a limited time to file a lawsuit, and this time is surprisingly short in some states.

What Prompted the 2010 DePuy Hip Replacement Recall?

On August 24, 2010, DePuy Orthopaedics voluntarily recalled its metal-on-metal implants and systems. The statement about the recall pointed to newly released data from the National Joint Registry of England and Wales. DePuy said this data was significant enough to convince it to stop any further procedures with its metal-on-metal products and to warn patients with the implants about the risk of premature failure.
According to the report from DePuy, the new data showed that more than one in ten patients (13 percent of patients implanted with the ASR total hip replacement system and 12 percent implanted with an ASR resurfacing device) who received one of the defective DePuy implants needed an additional surgery on the hip within the first five years. Additional surgery also brings with it additional risks, such as infection, limited mobility, and pain.

What Is the Current Status of the DePuy Hip Replacement Lawsuits?

If you required revision surgery after receiving an ASR or Pinnacle hip replacement, we may be able to file a lawsuit against DePuy Orthopaedics on your behalf. DePuy and parent company Johnson & Johnson have settled a number of lawsuits related to their metal-on-metal ASR hip implants and replacement systems.
The Judicial Panel on Multidistrict Litigation consolidated the lawsuits over DePuy’s Pinnacle implants into multidistrict litigation (MDL). This MDL is currently in bellwether trials, which give both the plaintiffs and DePuy an opportunity to see how a judge and jury react to the case they present. Often, bellwether trials lead to further settlement negotiations or plaintiffs dropping their cases.
The plaintiffs lost the first bellwether trial to DePuy, but the next three trials all resulted in large recoveries for the plaintiffs.
The second trial, in January 2016, led to the jury awarding the five claimants $502 million. The court lowered this to a total of $151 million on appeal.
In December of 2016, six more claimants won $1 billion in the third bellwether trial. These plaintiffs suffered additional complications when metal shards from the implant embedded in tissues around the hip.
In the fourth bellwether trial, a November 2017 decision granted six claimants a $247 million payout. They also suffered additional complications, including bone erosion and tissue loss, chronic pain, and inflammation.
While the DePuy lawsuits are well underway, we may still be able to file a lawsuit against the artificial hip manufacturer on your behalf. It is important to note, however, that the current claimants required revision surgery to repair or replace a defective implant. If you did not need surgery to repair your metal-on-metal implant, you may not be eligible to file a claim.
We can help you understand your legal right to compensation during a free case review. If you believe you may qualify, call us right away. The statute of limitations is short for this type of claim in many states.
